1. About Kind Magnets

Kind Magnets creates personalised photo magnets using photographs and images supplied by our customers.

Throughout these Terms & Conditions, “we”, “us” and “our” refer to Kind Magnets, and “you” or “customer” refers to the person using our website or placing an order.

 

2. Personalised Orders

Our magnets are personalised and made specifically for you using the photographs you upload when placing your order.

It is your responsibility to ensure:

• ·      You upload the correct photographs.
• ·      Your photographs are of suitable quality and resolution.
• ·      The photographs you upload are the photographs you would like used for your order.
• ·      Your order details and delivery information are correct before submitting your order.
• ·      Once production has commenced, we may not be able to change or cancel your order.

 

3. Photo Quality & Cropping

The quality of your finished magnets depends heavily on the quality of the photographs supplied.

For the best result, we recommend uploading clear, high-resolution, well-lit photographs.

Low-resolution, blurry, dark, heavily filtered or screenshot images may result in reduced print quality.

Photographs may need to be slightly cropped, resized or repositioned to fit the dimensions of our magnets. Important faces or details close to the edge of an image may therefore be affected.

By submitting your order, you acknowledge and accept that minor cropping may occur.

 

4. Colours & Appearance

Colours displayed on phones, computers and other screens may differ slightly from the colours of the finished printed product.

Minor differences in colour, positioning, cropping and appearance are normal characteristics of personalised printed products and are not necessarily considered defects.

 

5. Permission to Use Your Photos

By uploading photographs or other images to Kind Magnets, you confirm that:

• ·      You own the photographs or have permission to use them.
• ·      You have the necessary rights or permission to reproduce the images.
• ·      Your use of the photographs does not infringe another person’s copyright, intellectual property or other rights.
• ·      The images do not contain unlawful material.

You grant Kind Magnets permission to use the uploaded images solely as reasonably necessary to create and fulfil your order.

We will not use your personal photographs for advertising, social media or promotional purposes without your permission.

 

6. Inappropriate or Prohibited Images

We reserve the right to refuse or cancel an order containing material that we reasonably consider unlawful, seriously offensive, abusive, hateful, exploitative or otherwise inappropriate for us to reproduce.

If we cancel an order for this reason before production, we will contact you regarding the cancellation and any applicable refund.

 

7. Prices & Payment

All prices displayed on the Kind Magnets website are in Australian Dollars (AUD) unless otherwise stated.

The total amount payable, including any applicable shipping charges, will be displayed at checkout before payment is completed.

Payment must be successfully completed before your order is processed.

We reserve the right to change our prices, promotions and offers at any time. Any price changes will not affect orders that have already been successfully placed and paid for.

 

8. Promotions & Discount Codes

From time to time, Kind Magnets may offer sales, promotional offers or discount codes.

Unless otherwise stated:

• ·      Promotions cannot be combined with other offers or discount codes.
• ·      Promotions apply only during the advertised promotional period.
• ·      Discount codes must be entered at checkout.
• ·      Discounts cannot generally be applied retrospectively to completed orders.
• ·      Promotional offers are subject to any additional conditions advertised with the promotion.

We reserve the right to modify or withdraw promotions where reasonably necessary, subject to applicable law.

 

9. Order Changes & Cancellations

Because our products are personalised, please contact us as soon as possible if you need to change or cancel an order.

If production has not commenced, we will try to accommodate your request.

Once your personalised order has entered production, we may be unable to change or cancel it.

 

10. Change-of-Mind Returns

Because Kind Magnets products are personalised and made specifically for each customer, we generally do not accept returns or provide refunds simply because you change your mind, choose an incorrect photograph, or no longer want the product.

This does not affect any rights you may have under the Australian Consumer Law.

 

11. Faulty, Damaged or Incorrect Orders

We take care when creating and packing every Kind Magnets order.

If your order arrives damaged, faulty, or is different from what you ordered due to an error on our part, please contact us as soon as reasonably possible and provide:

• ·      Your name
• ·      Your order number
• ·      A description of the issue
• ·      Clear photographs showing the problem

We will assess the issue and provide an appropriate remedy in accordance with the Australian Consumer Law, which may include a replacement, repair or refund depending on the circumstances.

Nothing in these Terms & Conditions excludes, restricts or modifies any consumer guarantee, right or remedy that cannot lawfully be excluded under the Australian Consumer Law.

 

12. Shipping & Delivery

Orders are shipped to the delivery address provided at checkout.

Customers are responsible for ensuring their delivery information is complete and correct before submitting an order.

Any delivery timeframes displayed on our website are estimates unless expressly stated otherwise. Delays may occasionally occur due to postal or courier networks or circumstances outside our reasonable control.

If you believe your parcel has been lost, significantly delayed or delivered incorrectly, please contact us so we can assist you.

Additional charges may apply where an order needs to be resent because an incorrect or incomplete delivery address was supplied by the customer, except where the issue was caused by us or where applicable law provides otherwise.

 

13. Processing Times

As every Kind Magnets order is personalised, we require time to create your magnets before they are dispatched.

Any processing timeframe displayed on our website is separate from the estimated shipping or delivery timeframe.

Processing times may be longer during busy periods, promotions, Christmas and other peak periods.

 

14. Website Information

We aim to ensure the information displayed on our website is accurate and up to date.

However, photographs of our products are provided for illustrative purposes, and minor variations may occur between products shown online and the finished personalised product.

If we discover a significant error affecting an order you have placed, we will contact you where appropriate.

 

15. Intellectual Property

Unless otherwise stated, the Kind Magnets name, branding, logo, website design, graphics and original website content belong to Kind Magnets or are used with permission.

They may not be copied, reproduced, distributed or used commercially without our permission, except where permitted by law.

Customer photographs remain the property of their respective owners.

 

16. Privacy

We collect and use personal information as necessary to process orders, provide customer service and operate our business.

Please refer to our Privacy Policy for more information about how personal information and uploaded photographs are handled.

 

17. Limitation of Liability

To the maximum extent permitted by law, Kind Magnets is not responsible for loss or damage arising from circumstances outside our reasonable control.

Nothing in these Terms & Conditions is intended to exclude, restrict or modify rights or remedies that cannot legally be excluded, including rights under the Australian Consumer Law.

 

18. Changes to These Terms

We may update these Terms & Conditions from time to time.

The version published on our website at the time you place your order will generally apply to that order.

 

19. Australian Consumer Law

Our goods come with guarantees that cannot be excluded under the Australian Consumer Law.

These Terms & Conditions should be read subject to those rights and guarantees.

 

20. Governing Law

These Terms & Conditions are governed by the laws applicable in New South Wales, Australia, and applicable Commonwealth laws.
